The Equal Employment Opportunity Commission’s flip to Democratic control at the tail end of fiscal 2023 sets the table for the agency to further ratchet up litigation and investigations this year.

That’s the take of attorneys at Seyfarth Shaw, which has just released its annual “EEOC-Initiated Litigation” report. The law firm notes the Senate’s July 14 confirmation of Kalpana Kotagal as an EEOC commissioner was a watershed moment because it flipped the commission to Democratic control for the first time since President Joe Biden, a champion of pro-labor policies, took office in 2021.
