It’s been six years since Pennsylvania’s Office of General Counsel instituted a competitive procurement process for legal work that takes measures to ensure small and diverse law firms have a chance at winning contracts. In that time, one of the most often repeated criticisms by lawyers involved in the program is that too few people know about it.
Under the program, the number of diverse law firms doing work for the commonwealth has ballooned, and the state has saved significant legal spend by making the bidding process competitive.

When the defendant’s product—designed and sold outside the commonwealth—is used in the forum state while in a defective condition (that existed when it was first released into the stream of commerce) and the injury occurs in the forum, and the defendant markets lots of its products in Pennsylvania, the tort has “arisen out of or relates to” the defendant’s activities, and jurisdiction lies in the commonwealth.
“We think we’re going to grow significantly in the qui tam space in Philadelphia,” partner Daniel Miller said.
