• Artificial intelligence (AI) is a fast-growing area of computer science. Currently, numerous industries and sectors use AI products to some extent. This usage is expected to expand rapidly in future years, including within the legal industry.

• AI uses a wide variety of mathematical and statistical algorithms and other strategies to make predictions, recommendations, or determinations in a variety of situations, including situations that are novel or vague. Today's AI often uses machine learning to make the AI more powerful and accurate.

• We will discuss how AI will affect intellectual property including a discussion of:

  • Patents
  • Trademarks
  • Trade Secrets

Description

Conversations around generative artificial intelligence are dominating the social stratosphere. By simulating human cognitive thinking, generative AI can produce new types of text, imagery, audio, and synthetic data by using patterns and informational elements obtained from prior works. Because generative AI often relies on pools of data and third-party creations to create new content, there is a concern that generative AI may, whether intentionally or inadvertently, exploit copyright-protected content to develop purportedly original content. Organizations that leverage generative AI tools should be mindful of how the tools are used in a commercial context to mitigate the risk of infringing uses. Likewise, owners of intellectual property should be aware of how their works are used by generative AI models and the users of these tools, and timely action should be taken to defend intellectual property against infringement.

Mr. Lanquist's legal practice focuses on patent, trademark, and copyright litigation, intellectual property counseling, trademark prosecution, and technology law. With more than 30 years of practicing intellectual property (IP) law, he has legal experience with a variety of IP issues. He has prosecuted more than 150 patent applications and more than 1,400 trademark registration applications. This vast IP prosecution experience lends itself well to the courtroom, where he has litigated more than 170 intellectual property cases.

Prior to joining Baker Donelson, Mr. Lanquist co-founded a full-service intellectual property and technology law firm based in Tennessee, where he practiced for 30 years. Over the course of his career, he has developed intellectual property protection programs for at least 40 companies. He has also developed trade secret protection plans and has conducted due diligence on several corporate transactions.

Clients benefit from Mr. Lanquist's extensive IP prosecution and litigation experience. He counsels clients on how to structure their IP portfolios, as well as the economic implications of IP protection and litigation. He has performed numerous patent studies, including freedom to operate, non-infringement, and invalidity opinions, and more than 1,000 trademark use and registration opinions.

Mr. Lanquist provides pro-bono services to non-profit organizations in their attempts to protect trademarks.
