This program is intended to provide transactional attorneys and in-house counsel with an overview of traditional and emerging IP valuation methods and portfolio management strategies.

Intellectual property is increasingly recognized as a revenue-generating asset class that is on par with traditional corporate assets. As a consequence, the valuation and management of complex IP portfolios has become an item of critical importance to the M&A deal-making process in the technology sector.

Leading attorneys, economists, and valuation experts will discuss the dos and don'ts of IP valuation and portfolio management in a transactional context. Discussion topics will include 101 validity risk, discounts for lack of marketability, and IP monetization strategies.

Philip Kline

Managing Director

Philip W. Kline is a Managing Director at 284 Partners, LLC.

Mr. Kline has extensive experience in IP valuation and monetization, including assisting clients in negotiation IP licenses. He has represented a broad range of clients, including charitable foundations, small companies, and multi-national corporations. Mr. Kline has valued IP in a variety of contexts, including damages quantification, bankruptcy, tax planning, and tax disputes. Mr. Kline has assisted in the quantification of damages resulting from numerous causes of action, including patent infringement, copyright infringement, trademark infringement, theft of trade secret, unfair competition, unjust enrichment, breach of contract, and false advertising.

Mr. Kline’s experience also spans a variety of industries. He has worked extensively in the wireless telecommunications space, assisting both licensors and licensees in assessing whether proposed royalty rates for standard essential patents are fair, reasonable, and non-discriminatory. He has also worked on engagements pertaining to medical devices, consumer electronics, industrial networking, and transportation.

Mr. Kline has held, and continues to hold, a variety of leadership positions in industry organizations. He is currently the American Bar Association (ABA), Intellectual Property Law (IPL) Section’s liaison to the Licensing Executive Society’s Intellectual Property Valuation and Standards Committee. He is a member of the ABA, IPL Section’s continuing Legal Education Board, and the past chair of the ABA, IPL Section’s Economics of the Profession Committee. Mr. Kline is also a past member of the Certified Licensing Professional Exam Development Committee.

Mr. Kline has been named one of the World’s Leading IP Strategists by Intangible Asset Management. He is a Certified Public Accountant (CPA) licensed in the state of Illinois and Certified Licensing Professional (CLP) – a designation started by the Licensing Executive Society.

Mr. Kline holds a B.A. from The University of Southern California in Economics and International Relations, Magna Cum Laude.

Mr. Anson, Chairman of CONSOR, is a seasoned licensing valuation and marketing professional with a long history of successful programs at firms such as Booz-Allen & Hamilton, Playboy Enterprises and Hang Ten International.

Weston holds a Masters degree in Business Administration (honors) from Harvard University and is active in all of the major international trademark and intellectual property associations as a speaker and an officer. Wes is a prolific author on the subject of licensing and intellectual property and has published over 150 articles in the United States and overseas. Since founding CONSOR in San Diego over twenty years ago, Wes has constructed and implemented numerous licensing programs for major corporations and has performed valuations of hundreds of intellectual property components.

Efrat Kasznik

Ms. Kasznik is an intellectual property (IP) and valuation expert, with close to 20 years of consulting experience, focusing on assisting clients with the creation, commercialization and monetization of their intangible assets and technologies. She specializes in analyzing and valuing IP portfolios for a range of purposes, including: mergers & acquisitions, financial reporting, technology commercialization decisions, tax compliance, transfer pricing, litigation damages and business liquidations. She has worked with corporate clients that range in size from Fortune 100 to start-ups, law firms, universities, research institutions, inventors, IP brokers and patent funds.

Ms. Kasznik is the founder and president of Foresight Valuation Group, a Silicon-Valley based intellectual property, valuation and start-up advisory firm. She teaches a class on IP Management at the Stanford Graduate School of Business, and is a frequent speaker and author on IP valuation and strategy issues. Prior to founding Foresight, Ms. Kasznik was Senior Vice President with ICMG, a consulting firm specializing in intellectual capital management, where she led the IP valuation practice for close to a decade. She moved on to become a Director with LECG, a global litigation consulting firm, where she created a new practice area focused on Intellectual Asset Management. Throughout her career, Ms. Kasznik also served as a co-founder and advisor to several Silicon Valley start ups, including serving as Chief Financial Officer at a telecom start-up, and most recently as a co-founder of an energy efficiency start up, where she is also designated as co-inventor on patents related to analyzing residential energy usage.

Ms. Kasznik is actively involved with the Licensing Executives Society (LES), as a member of several committees and as a sponsor of the LES-Silicon Valley Chapter. She serves as a mentor to several startup incubators in the US and in Europe, and routinely advises startups on topics related to business strategy, financial modeling and IP portfolio management.

Ms. Kasznik received an MBA from the University of California, Berkeley, and a B.A. in Accounting and Economics from the Hebrew University, Jerusalem.
