Description

Employers across the nation are confronting a host of new or amended employment laws addressing pay equity, pay inquiry, and paid sick leave. For instance, various U.S. municipalities and states, including New York City, Philadelphia, New York, California, and Puerto Rico have also enacted new legislation that prohibits employers from asking applicants about their current or past salary, creating additional compliance and recruitment challenges for employers. Additionally, various states and localities have adopted or are considering mandatory paid sick leave laws, adding to the assortment of new employer requirements. So what will the future workplace look like for women?

This session will cover:
  • Current state of pay discrimination law in key jurisdictions
  • Potential future components of employee benefits and protections being considered at the State and Federal level
  • Should employers adopt one universal approach to these laws, anticipating the continued liberalization of laws, versus a multi-jurisdictional approach?

Michelle Anderson

Partner

Michelle Anderson represents employers in all aspects of employment law in both state and federal courts, and before administrative agencies. Her practice focuses on representing employers against claims of unlawful discrimination, harassment, wrongful termination, violations of leave and disability laws, and wage and hour related issues.

Michelle also litigates and advises employers on issues arising out of employee defection, including the prosecution and defense of claims involving non-compete and non-solicitation agreements, breaches of fiduciary duty and violations of trade secret laws.

Michelle provides guidance in the areas of employee handbooks, wage and hour compliance, policy and procedure development, and management training. Her entire legal career has focused on labor and employment law.

Michelle has participated in more than two dozen employment practices reviews; including large multi-state employee handbook and policy reviews that cover all 50 states. She has provided policy advice and evaluation to employers as small as five and to those with thousands of employees.

Her experience covers a variety of industries, including, but not limited to, staffing, healthcare, dentistry, production, manufacturing, restaurant, and hospitality. Michelle has also conducted wage and hour audits to determine proper employee classifications and payment under the Fair Labor Standards Act (FLSA).

Prior to practicing law, Michelle had a successful career in workforce development where she operated employment and training programs for a private non-profit corporation under contracts from the Department of Labor (DOL), the Washington State Department of Community, Trade, and Economic Development (CTED), and the Department of Social and Health Services (DSHS).

Michelle's background in executive management and workforce development has yielded practical knowledge and experience in addressing numerous workplace issues. Michelle has wide exposure to the challenges facing today's businesses and supervisors; ranging from compliance with state and federal employment requirements to hiring, training, evaluating, and retaining employees in an ever changing labor market.

Michelle was included in Louisiana Super Lawyers - Rising Stars in 2016.

Latoya Asia is VP, Global Head of Inclusion, Diversity & Belonging at Verisk Analytics, a leading data analytics and risk assessment firm. In her role, Ms. Asia focuses on enhancing an inclusive culture and greater diversity, and developing and executing initiatives, policies, programs, and training that create measurable impact. Before joining Verisk, Ms.

Asia served as Director, Associate General Counsel at E*TRADE Financial Corporation, providing day-to-day and strategic legal counsel on a range of employment and diversity & inclusion matters impacting the company.

Ms. Asia also drove diversity & inclusion efforts within the company, advising senior leadership and employee resource groups and influencing actions that supported an inclusive work environment. Ms. Asia’s experience also includes service as a strategic human resources and labor relations business partner at a global petroleum additive manufacturing company, a teacher at a K-12 school in Niamey, Niger, and as a labor and employment attorney at an international law firm. Ms. Asia holds a J.D. from the College of William and Mary and a B.S. from Virginia Commonwealth University. Outside of work, she enjoys spending time with her family, international travel, and cooking. She serves on the boards of several professional and civic organizations and is a mentor to many.

Prior to joining E*TRADE, Ms. Asia practiced labor & employment law at a large law firm where her practice predominantly involved representing and counseling employers in the areas of employment discrimination, labor-management relations and general employment litigation. While at the firm, Ms. Asia also gained invaluable experience as an integral member of a complex, multiyear, federal trade secret misappropriation litigation team.

Jewelle has been named as one of the "Top 25 Power Women to Watch" by Atlanta Woman magazine, selected on numerous occasions as one of "Georgia's Rising Star Super Lawyers" by Atlanta and Law & Politics magazines, and featured as one of 14 attorneys "On the Rise" by the Fulton County Daily Report.
