Newman v. Graham

This interlocutory appeal follows the trial court's refusal to dismiss appellee's health care liability claims against appellant. In one issue, appellant complains the trial court erred by overruling his objections to the qualifications of appellee's expert and denying his motion to dismiss appellee's health care liability claims. The trial court has broad discretion in determining the admissibility of expert testimony in a health care liability case. A trial court abuses its discretion only if it acts arbitrarily or capriciously or without reference to any guiding rules or principles. The trial court did not abuse its discretion by concluding the expert was qualified to render those opinions or by denying the motion to dismiss appellee's health care liability claims.
