As they rack up wins in their ramped-up enforcement of the Foreign Corrupt Practices Act, the U.S. Department of Justice and Securities and Exchange Commission have a simple message: You ain’t seen nothing yet.
SEC director of enforcement Robert Khuzami promised more “proactive” investigations in announcing plans for an FCPA – dedicated unit under his command last August. And Lanny Breuer, assistant attorney general for the Justice Department’s criminal division, pledged to “aggressively” enforce the statute in January while unveiling indictments against 22 employees of various military and law enforcement contractors who had been caught in an extraordinary FCPA undercover operation.
