Let us explain. For the last five years, Kessler has been representing a food distributor called Feesers in a price discrimination case against Michael Foods and Sodexho. Feesers alleged that Michael Foods discriminated against it by offering lower prices for its egg and potato products to Sodexho, a food service management company. Feesers also alleged that Sodexho induced Michael Foods to offer it lower prices. Feesers was not seeking damages, just injunctive relief.

The case went to trial for three weeks back in January 2008 before Harrisburg, Pa., federal district court judge Sylvia Rambo. It took Judge Rambo a while, but on Monday she issued an opinion in favor of Feesers. Rambo enjoined Michael Foods from “discriminating unlawfully in price in favor of Sodexho and against Feesers,” and enjoined Sodexho from “continuing to induce or receive unlawful price discrimination from Michael Foods.”
