Joseph Kilcullen v. New York State Dept. of Labor, et al.

Since Congress validly abrogated 11th Amendment immunity under ADA and Rehabilitation Act through valid exercise of its Fourteenth Amendment enforcement powers, employee's action in federal court against state employer was not barred.
