Diane P. Wood, Circuit Judge. Two points in thearea of public labor relations are by now wellestablished. First, public employers may have acollective bargaining agreement with a union thatrequires all employees, union members andnonmembers alike, to contribute to the union’srepresentational activities–that is, theagreement may include a “union security clause.”Second, those who object to nonrepresentationalactivities of the union have the right to payfees that exclude contributions to thoseactivities–so-called “fair share fees.” SeeHudson v. Chicago Teachers Union Local No. 1, 475U.S. 292, 302 (1986), citing Abood v. Detroit Bd.of Educ., 431 U.S. 209 (1977).
