Last week in oral arguments, the California Supreme Court appeared ready to affirm a decision striking a collective bargaining agreement that required the state to make every effort to use state employees, rather than private companies, to perform architectural and engineering services for public works projects. Lower courts have ruled that the agreement runs afoul of Prop 35, which gave the state the right to contract with private companies, especially if it results in cost savings.

If Sacramento, Calif., attorney James Corn wasn’t aware that he didn’t have to try very hard during oral arguments Thursday, California Supreme Court Justice Joyce Kennard left him no doubt.
“From your standpoint, this is an easy case, isn’t it?” Kennard said, with a subtle smile that suggested Corn had a win in his pocket already. “You have a lot of strong points on your side.”
