In the U.S., alternative dispute resolution provides an array of effective options to the construction industry. However, the use of ADR, and mediation in particular, is not nearly as developed in Latin America. Understanding why this is the case is the first step toward increasing the acceptance and use of mediation in that region. Attorney Jerry Brodsky provides one theory explaining the lack of reliance on ADR in Latin America, and describes some countries' efforts to increase its use.

A survey conducted between 1988 and 2002 of more than 1,000 construction projects reveals that dispute resolution boards (DRBs) resolved disputes allowing the parties to avoid the costs and uncertain outcomes in litigation in 97.9 percent of the cases.
