A Pennsylvania court has denied a preliminary injunction motion in a noncompete dispute involving an ad man who went to work in-house for a former client of his former employer. The defendant had worked on the client's advertising for several years before he went to work for the plaintiff agency. The court noted that in general, it will be difficult for a plaintiff to demonstrate that an employee securing in-house employment with a noncompeting client has violated a noncompete agreement.

Allebach Creative Associates had accused Michael Schwartz of breaching his employment contract by going to work for Manncorp, an industrial equipment company and former Allebach client, after leaving the agency.
