At the urging of an insurance company, a New Jersey state appeals court Friday threw out $15.3 million in malpractice settlements reached between eye surgeon Joseph Dello Russo and 13 patients.
Dello Russo made the settlements in 2004 when Princeton Insurance Co. reserved its right to deny coverage shortly before trial in New Jersey’s Bergen County, and a judge said the carrier had to pay.
