Super Lawyers and Best Lawyers in America may present expert testimony to bolster their argument that the New Jersey ethics rule against ads comparing lawyers’ qualifications is unnecessary and harms consumers, a special master says.

Retired Judge Robert Fall told lawyers on June 12, at a hearing in Ocean County, N.J., that he wants to gather evidence on the necessity of the stricture, Rule of Professional Conduct 7.1(a)(3), and on what controls would be appropriate if comparative ads were permitted.
