In a case decided with the help of retired U.S. Supreme Court Justice Sandra Day O'Connor, the 2nd U.S. Circuit Court of Appeals has used a Voting Rights Act case to clarify the proper application of the forum rule for calculating attorney fees. "Our fee-setting jurisprudence has become needlessly confused -- it has become untethered from the free market it was meant to approximate," said the appeals court. "The reasonable hourly rate is the rate a paying client would be willing to pay," the court held.
