Western Refining and Giant Industries promised to take on the Federal Trade Commission after the agency voted to sue if the companies pursue their $1.4 billion merger. In a press release following the vote Tuesday, the companies said they "intend to vigorously challenge the FTC in court." The director of FTC's bureau of competition said the unanimous vote to block the deal was due to competition concerns regarding the northern New Mexico market for auto fuel, where the two companies are currently rivals.
