A lawsuit by ABC, CBS, Fox Broadcasting and other major networks charging the operators of a nationwide truck stop chain with copyright infringement can proceed.
Southern District of New York Judge Deborah A. Batts, in American Broadcasting Companies v. Flying J, 06 Civ. 2697, denied truck stop Flying J’s motion to dismiss the claim, finding that the company’s sale of commercials to replace network advertising on televisions at its truck stops was not protected under an exemption to the federal copyright law.
