Nine states have sued the Bush administration in the D.C. Circuit, saying a rule regulating emissions of mercury and other pollutants at cement plants does not comply with the Clean Air Act. In December, the EPA announced new limits on mercury and hydrocarbon emissions from cement kilns built after Dec. 2, 2005, but critics say emissions should be limited from all kilns, not just new ones. Several environmental groups filed a separate action last week.
