Rather than run criminal-background checks on the jury pool, most courts rely on jurors to come clean about arrest records or convictions. Indeed, the Administrative Office of the U.S. Courts keeps no data on which courts run background checks. But that may be changing, especially for high-profile cases. In the upcoming trial of Lewis "Scooter" Libby Jr., Special Counsel Patrick Fitzgerald has asked for criminal background screening of potential jurors before lawyers make their final selections.
