A Miami couple is asking a judge to force the Florida Department of Law Enforcement to remove from its publicly accessible online database their teenage daughter's arrest record for stealing a can of soda. The complaint, filed in Miami-Dade Circuit Court, asks for a declaratory judgment stating that FDLE's publication of the record is a violation of a state statute requiring that minors' misdemeanor records be kept confidential. It also seeks to prevent the agency from publishing or selling the record.

The record details the Oct. 15, 2006, arrest of then 13-year-old G.G. for shoplifting. It was the girl’s first arrest. Her parents’ names were not included in the complaint.
