A federal judge has turned down the dimmer on efforts by CVS, Wal-Mart and Costco to sell a type of twinkling lights next holiday season.
Finding that defendants CVS and Everstar Merchandise infringed on a valid patent, Southern District of New York Judge Denise Cote, in Sienna v. CVS, 06 Civ. 3364, granted plaintiff Sienna’s motion for summary judgment.
