A federal judge in New York has turned down the dimmer on efforts by CVS, Wal-Mart and Costco to sell a type of twinkling lights next holiday season. Finding that defendants CVS and Everstar Merchandise infringed on a valid patent, the judge granted plaintiff Sienna's motion for summary judgment. In 2002, Sienna patented its light design that prevented a fire hazard found in some other twinkling lights, but discovered last year that competitor Everstar sold an identical product at a cheaper price.
