A Florida appeals court has reinstated a motion alleging discovery abuses in a Benlate fungicide case by chemical manufacturer DuPont. The Ecuadorean shrimp farmer plaintiffs alleged that DuPont hid a U.S. Environmental Protection Agency study on the effects of Benlate runoff in water. At trial, DuPont's defense was that there was no proof that runoff could occur with Benlate. The motion potentially could lead to stiff punitive damages and cause the case -- which DuPont won on appeal -- to be retried.
