Like so many of his colleagues on the federal district bench, Seattle Judge Robert Bryan chafed under the mandatory sentencing guidelines that removed much of a jurist's discretion in determining penalties. So when the U.S. Supreme Court last year ruled the guidelines were no longer mandatory, Bryan asked for a chance to turn back the clock. Citing "extraordinary" circumstances, the 9th Circuit on Wednesday granted that request. But Judge Consuelo Callahan had plenty to say in a dissenting opinion.
