Federal Communications Commission General Counsel Sam Feder late Friday issued an opinion freeing Republican commissioner Robert McDowell to vote on BellSouth Corp.’s $80 billion merger with AT&T Inc.

If McDowell chooses to unrecuse himself from voting on the deal, his vote is expected to break a 2-2 commission stalemate that has prevented the merger from winning the final regulatory approval necessary for the deal to close.
