In the latest decision in the KPMG case, Southern District of New York Judge Lewis A. Kaplan held that former KPMG equity partner Carol Warley could not claim attorney-client privilege for speaking with attorneys retained by her company on matters involving both her and her employer, as she did not receive legal advice on "personal matters." Kaplan denied her motion to suppress potentially damaging evidence from the conversations or to dismiss the indictment filed in 2005 against her.
