Cash balance plans are age discriminatory under the Employment Retirement Income Security Act (ERISA), a federal judge has ruled.

Judge Harold Baer became the first judge in New York’s Southern District to make that finding and the second judge to do so in the courts of the 2nd Circuit, which will eventually have to resolve a split on the issue.
