Judge Robert A. Pete denied a request to dismiss the city's claim alleging gun makers do little to control the flow of handguns used in crimes. The federal Protection of Lawful Commerce in Arms Act became law in response to a wave of lawsuits from cities, but Pete ruled the law would deprive Gary of due process rights.
