Sony and Bertelsmann have asked the European Union's top court to reverse a decision rescinding their music joint venture, the court said last week. The appeal to the Luxembourg-based European Court of Justice comes nearly three months after a lower court overturned the European Commission's July 2004 approval of the deal creating SonyBMG Music Entertainment. John Cook, a Brussels-based antitrust lawyer, said the appeal will allow SonyBMG to exist for two more years before any final regulatory outcome.

Sony Corp. and Bertelsmann AG have asked the European Union’s top court to reverse a decision rescinding their music joint venture, the court said Thursday.
The appeal to the Luxembourg-based European Court of Justice comes nearly three months after a lower court overturned the European Commission’s July 2004 approval of the deal creating SonyBMG Music Entertainment. It was the first time that court had annulled a merger clearance.
