The New Jersey Supreme Court suspended Passaic County Superior Court Judge Randolph Subryan for two months without pay after finding credible evidence he kissed a female law clerk against her wishes. Chief Justice Deborah Poritz said the justices believed the allegations by former clerk Jennifer Breaton and rejected Subryan's denials. The state paid Breaton $300,000 in February to settle her sexual harassment suit without admitting liability on Subryan's part.

Writing for a unanimous court in In the Matter of Randolph M. Subryan, D-34-04, Chief Justice Deborah Poritz said the justices believed the allegations by former clerk Jennifer Breaton and rejected Subryan’s denials.
