Seven months after it became law, the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 has encountered its first constitutional challenge.
The National Association of Consumer Bankruptcy Attorneys and the Connecticut Bar Association filed a lawsuit on Thursday in the U.S. District Court for the District of Connecticut seeking a preliminary injunction against three BAPCPA provisions.
