The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 has encountered its first constitutional challenge. The National Association of Consumer Bankruptcy Attorneys and the Connecticut Bar Association have filed a lawsuit seeking a preliminary injunction against three BAPCPA provisions. According to the suit, the challenged provisions create requirements for "debt relief agencies" that appear to prohibit consumer bankruptcy attorneys from providing potential clients with lawful legal advice.
