Court-ordered restitution is not a violation of a defendant’s constitutional rights under the Supreme Court’s 2005 decision in U.S. v. Booker, a unanimous 11th Circuit panel has ruled.
The 11th Circuit is the eighth federal circuit to make that holding. The case is USA v. Freddy J. Williams / 04-15117.
