Congress has been busy of late considering and enacting "tort reform" laws limiting civil liability. Recently, it has taken up measures creating immunities for certain industries, including guns and fast food. According to law professors Frank McClellan and Mark Radhert, these shield laws represent political payoff for industry special interests that don't serve public welfare. In fact, McClellan and Radhert write, they directly interfere in state tort law decisions about public health and safety.
