Time Inc. has asked a federal judge to throw out its just-announced settlement with former University of Alabama football coach Mike Price, claiming that Price and his attorney “flagrantly breached” the agreement’s confidentiality terms.
In a dismissal motion filed late Tuesday, attorneys defending Time, Sports Illustrated and SI writer Don Yaeger notified Judge C. Lynwood Smith Jr. of Alabama’s Northern District that Price and Birmingham attorney Stephen D. Heninger of Heninger, Burge, Vargo & Davis had “deliberately and flagrantly” breached the settlement in their statements to the media.
