Prosecutors in Manhattan have won a significant ruling on the issue of hearsay exceptions, which have been the subject of great debate since a U.S. Supreme Court decision last year. New York's Appellate Division, 1st Department said that statements made to an officer who asks "What happened?" when responding to a crime scene are more like excited utterances than testimonial statements. The ruling may be particularly important for domestic violence cases in which victims are reluctant to testify.
