The Supreme Court appeared sharply divided Tuesday over a case that could set new minimum standards for effective assistance of counsel in death penalty cases. Rompilla v. Beard also raises the issue of when capital case jurors must be told that an alternative sentence of life without parole actually means the defendant will never get out of prison. But much of the oral argument was spent with justices questioning the diligence of trial lawyers who defended Ronald Rompilla on murder charges.
