With its skyrocketing utility bills, rolling blackouts and bankruptcies, California's energy crisis seemed like an easy plaintiffs' case. But in recent opinions, the 9th Circuit has decided against ratepayers. However, the court also ruled that the Federal Energy Regulatory Commission abused its discretion by declining to order refunds stemming from reporting violations. "[It] is the one bright spot in the recent spate of 9th Circuit rulings," says Lieff Cabraser's Barry Himmelstein.
