You have probably heard of the national “do not call” list. You might have even signed up yourself. But did you know that under a different section of the same statute, if your business or law firm sends an unsolicited fax to someone, it could cost you from $500 to $1,500 per fax? That’s just enough to make you call your lawyer, but not enough to spend the time to fight it. And believe it or not, it’s the law. Although enacted as a draconian measure to stop broadcast fax houses from stuffing your fax machine, the Telecommunications Consumer Protection Act provides the latest class action litigation target for plaintiff lawyers. Like so many other efforts to regulate, the “junk fax” statute has gone from being a good idea aimed at cutting back on abuses to becoming a significant liability to legitimate business. Today, given the present state of the law, a marketing fax to a large number of potential contacts can get you into hot water. Here are some things to keep in mind.
