The pending appeal of a New York workers compensation ruling pits the children of victims of the Sept. 11 terrorist attacks against victims' fiancees and domestic partners. At issue is a provision that gives domestic partners the same rights as surviving spouses. While numerous suits have contested payments made, or not made, to domestic partners from the federal Victim Compensation Fund, the pending appeal appears to be the first provision challenge to reach New York's Appellate Division.
