In a case eyed by white-collar practitioners, McKesson Corp. has asked a 9th Circuit panel to keep plaintiff attorneys off the coattails of government prosecutions of alleged corporate wrongdoing. At issue is an internal investigation done by Skadden, Arps, Slate, Meagher & Flom after McKesson discovered improperly recorded revenues after a merger. That investigation was handed over to the DOJ and SEC. Now, attorneys for former executives indicted by the DOJ want the internal report.
