A Tennessee resident who telecommutes to his New York employer must pay income tax on all his earnings although he spends only a fourth of his time in the Empire State, an appellate panel said Thursday, noting that Thomas Huckaby's income is New York-sourced and that he telecommutes for his convenience rather than his employer's. The ruling came just days after the U.S. Supreme Court declined to hear Cardozo Law School professor Edward Zelinsky's appeal on double taxation.
