A federal judge in New York has asked a circuit court whether he can consider the habeas petition of a man whose attorney failed to file papers during a second appeal to the state's high court. Judge Frederic Block found the Supreme Court limits the right to counsel following a first state-level appeal, but he questioned whether the need for counsel is heightened once leave has been granted for a discretionary appeal.
