A defense attorney's inaccurate advice regarding the deportation consequences of a guilty plea can constitute ineffective assistance only if there is a showing of prejudice, the New York Court of Appeals has found. In People v. Bruce McDonald , the state's high court refused to reverse the plea of a foreign national in a drug case, because he failed to show that had the inaccurate advice not been given, he would have pleaded differently.
