A California appeals court upheld a $5 million age discrimination jury award against Nestle on Thursday, a ruling that opens the door for attorneys to use the state's unfair competition law in employment discrimination cases. The court said that employers that practice age discrimination have an "unfair competitive advantage" over those that don't because older workers are often more highly compensated than younger ones.
