The 3rd U.S. Circuit Court of Appeals has ruled that the Southeastern Pennsylvania Transit Authority's physical fitness test for job applicants of its transit police force is perfectly legal -- even though it has a "disparate impact" on women. The ruling comes more than five years after the suit began and is just the latest twist in what proved to be a legal roller coaster ride for both sides.
