The world’s No. 2 soft drink maker has tapped a McCutchen, Doyle, Brown & Enersen partner to be its top in-house attorney. David Andrews officially became general counsel and senior vice president of New York-based PepsiCo on Feb. 1. The move caps an illustrious career for one of McCutchen’s most distinguished attorneys and top rainmakers. In addition to working at San Francisco-based McCutchen for the better part of his 30-year career, Andrews has done high-profile stints in both the Carter and Clinton administrations. Andrews’ career move was somewhat unexpected for McCutchen partners, since PepsiCo was not a client of his or the firm. “I think that PepsiCo was interested in Dave because of his international experience with the State Department,” said McCutchen’s San Francisco managing partner, Dale Barnes Jr. “Given a person of Dave’s stature, it’s not surprising to me that a company like PepsiCo would recruit him.” While it’s still early, McCutchen partners made no secret they expect Andrews’ new job to translate into work for the firm. “We don’t see that this is a situation of losing a practice, but hopefully gaining a client,” Barnes said. In his new post at PepsiCo, Andrews will be responsible for all the company’s worldwide legal matters, which includes everything from anti-competitive matters to FDA issues. According to Andrews, he was attracted to the position by the chance to work with the company’s management and get involved in its international matters. “It’s an exciting and young, focused company,” said Andrews. In addition to his legal role, Andrews will head PepsiCo’s government affairs and its charitable activities through the PepsiCo Foundation. Andrews, 60, will move to New York but keep his home in San Francisco. This isn’t the first time Andrews has taken a leave of absence from McCutchen. In 1976 he served as legal counsel and special assistant for policy for the U.S. Environmental Protection Agency. And in 1997 he was the general counsel to the U.S. State Department as well as the legal adviser to then-Secretary of State Madeleine Albright. “This is a wonderful opportunity that Dave richly deserves,” McCutchen Chair Donn Pickett said in a statement. “It’s a terrific honor for him, and all of us at McCutchen wish him the very best.” Pickett and other McCutchen top brass played down the significance of any impact Andrews’ departure might have on the firm. When he left for the State Department five years ago, the firm transitioned his practice and a lot of his responsibilities to other partners, said Pickett. Colleagues credit Andrews with founding McCutchen’s environmental practice in the early 1980s. “He really built the practice from the ground up,” said Karen Nardi, McCutchen’s chair of the environmental and land-use group. That group, which now boasts 66 attorneys, is one of McCutchen’s core practices and contributed a quarter of the firm’s overall revenues last year. Andrews also served as McCutchen’s chairman between 1991 and 1994. Besides the famous soda, PepsiCo owns Frito-Lay, as well as the Gatorade/Tropicana and Quaker Foods North America brands. The snack and beverage giant boasts nearly $27 billion in annual revenues and 135,000 employees. “I have not yet banned all Coke cans,” joked Pickett.
