NEW YORK � Six plaintiffs suing Pharmatrak and its pharmaceutical clients filed a consolidated class complaint Feb. 23 but the Judicial Panel on Multidistrict Litigation will meet in Kansas City, Mo., on March 29 to consider creating an MDL in these “cookie” cases ( In re Pharmatrak Inc. Communications Litigation, No. 00 Civ. 6121 [DAB], S.D. N.Y.). Marcus Shroers and other plaintiffs allege that pharmaceutical companies who contract with the Boston-based data collection firm Pharmatrak are using cookies or web bugs to surreptitiously collect Internet browsing information and confidential personal data. They contend the activities violate the Electronic Communications Privacy Act and the Computer Fraud and Abuse Act, trespass, invasion of privacy and unjust enrichment. The information collected includes browsing habits, medical histories, full names and addresses, email addresses, phone numbers, Uniform Resource Locators and other personal demographic data, plaintiffs complain.
