A federal judge issued a preliminary injunction ordering AOL Time Warner’s Internet service unit to stop using software developed by PlayMedia Systems Inc. In the order issued Oct. 26 and made public Monday, U.S. District Court Judge A. Howard Matz said it was likely that PlayMedia, based in Los Angeles, would win on the merits of its lawsuit asserting that AOL violated the terms of a 1999 licensing agreement. The injunction ordered AOL to eliminate PlayMedia’s software from all versions of its AOL 6.0 Internet software and halt all distribution of AOL 6.0. “This is a preliminary ruling and we respectfully disagree with it,” Jim Whitney, an AOL spokesman said Tuesday. “We are seeking a stay and will pursue an immediate appeal.” PlayMedia makes software that plays music files coded in the MP3 format. The company licensed its software to Nullsoft Inc. in 1999 for use in the program Winamp. AOL bought Nullsoft and used the music player in its AOL 6.0 software. PlayMedia claimed that AOL should have negotiated a separate licensing agreement. The company now distributes an updated version of its service, AOL 7.0, which does not use the Nullsoft player.
