The use of the trademarks of others as "metatags" associated with a client's Web site can create trademark infringement liability. Often, individuals creating the metatags may not even be aware that such use can constitute infringement. Traditional clearance searches and monitoring may not be enough to protect a client from infringing the trademarks of others, or from having its own trademarks infringed.
