Something like 95 percent of civil cases never make it to trial, so the vast majority of deposition transcripts are never used in court. That is a blessing, since most transcripts don't live up to their potential. Lawyers rarely think of a deposition as being anything other than a discovery tool. But they should be thinking about how they might actually use the transcript at trial.
